Hey all.
I recently received a notice from the county tax accessors office stating that I will be getting a tax bill on my boat if it was registered and / or stored in L.A. county on Jan. 1, 2005.
I was wondering if this is a new thing or if others have been nailed with this.
I have owned a boat in L.A. county for 23 years but last summer purchase a larger one (only 21' at a cost of $7000.00) to add to my fleet.
If I store it out of the county will that make them happy or does it also have to be registed out of L.A.?
Any replies, advice, jokes, whatever would be a help.

I pay aout $162 every summer for "luxury tax" on mine...."Luxury"? For a necessity like a fishing boat, geeze!! (That's Orange County)

I'm paying in Orange County also. Not sure what the trigger is, if it's the purchase/sale of a boat or has to do with the pricing. All the boats I've bought since I've been a resident of OC CA have ended up with a luxury tax bill. I didn't have any fees on my old flat-bottom I brought with me when I moved back to CA from Texas, and yes it was registered in CA.

I think it might be the length that throws up the flag. I remember "back in the day" all the 21'and longer daycruisers I saw were almost always flying Arizona tags and I knew of many that lived in Calif.
My other boat is a 1973 17' so maybe it is also the age ?

You folks might want to check the law on the "Tax Man" and the ability to tax a undocumented vessel.

The law they use says "unless otherwise exempt" and non commercial vessels are exempt under the sextion (pun intended) that is used to assess. Ask them to prove to you about the law and they have to send the code section, which you will find specifically exempts undocumented vessels.

An interesting side note is that Documented vessels are exempt from this local tax and the county has been raking in bucks for years and hates anyone who discovers these facts.

All in all, the county can't tax Documented vessels since they are federally registered and exempt, undocumented vessels are exempt and the only vessels that are taxable are commercial vessels unless they are documented and then they are under federal law.

A little checking and you will find why I have resisted them and forced them to into a real tizzy and unable to substantiate their scheme, causing them to send out their manual which is not valid law. Make them give you the code section and they will refuse and then back off.

Unless everyone fights for their rights, then all of us suffer. Stop paying unless they can prove that they are correct. They aren't and really don'y like it when you call them on it.

They will moan and groan, scream and threaten, yet ask for the law, read it and then decide if it applies or not. You might just find you have a claim against the county for refunds as well...

I would be interested in any actual history of successfully avoiding county taxes on a documented vessel.

I was paying $480. a year for the last couple of years..(Org Co.) Last year I requested a re-assessment and it was granted.. They were taxing me on the original sale amount and didn't factor in any depreciation. I appealed and included copies of "Nadaguides." They reassessed the value to current market and sent me a check for the overpayment..All together it took about 4 weeks and saved about $120.00. I see why there are so many Arizona boats around though.
